Aside from hating to see another Reaganesque justice on the Supreme Court, there are two instances in Judge Souter`s career that cause me great concern:

When state attorney general, he argued that New Hampshire had the right to have flags flown at half-staff on Good Friday, nothing but a religious holiday; on the state Supreme Court he held the Constitution should be interpreted ”as it was understood when the framers proposed it and the people ratified it.”

What happens when considering equal protection of the laws promulgated in 1868 when women couldn`t vote or hold office, and married women couldn`t own property?
