The Wheaton City Council has adopted new provisions in its developer donation ordinance that clarify the use of donated funds received by local taxing bodies, City Manager Donald Rose said.

Under the ordinance, developers are required to donate either land or money to the park district and local school district.

The provisions adopted at Monday’s City Council meeting state that such contributions must be paid directly to the city prior to the recording of the final plat for a development.

Money paid in lieu of park sites will be held in a special account by the city solely for the acquisition of park land or for the improvement of existing park land. The ordinance also requires that cash contributions be spent within the corporate boundaries or planning area of the city.

Similar provisions were adopted for contributions in lieu of school sites. The money must be used for improvements to a school building, the acquisition or improvement of a school site or the improvement of areas adjacent to a school that serves the needs of children from the subdivision or development.

Rose said the new provisions clarify the intent of the city and were not drawn up as the result of any particular problems.
