Two local businessmen who sued the city so they could build an apartment complex are a step closer to construction after City Council members Monday narrowly granted a court-ordered zoning change.

Aldermen voted 5-4 to rezone the property owned by Robert and James Trombino on the north side of Glen Flora Avenue, west of the North Shore bike path. The zoning change will allow the men to build a 108-unit apartment complex.

They originally requested a zoning change from one multifamily category to a more dense classification in late 1991 so they could build a 144-unit complex. Aldermen rejected the request after neighbors complained that the stormwater and sanitary sewage from the buildings could add to an already critical flooding problem.

The Trombinos then sued the city. In 1992, Lake County Circuit Judge William Block ordered both sides to work out an agreement, and a settlement was reached that would permit construction of a 108-unit development. In December, Block ordered the city to comply with terms of that settlement.
