A move to clarify the village’s zoning ordinance could help Downers Grove sidestep a lawsuit.
The Downers Grove Zoning Commission recommended last week that the Village Council approve an ordinance clarification that shows dormitories are considered a “principal” use rather than an “accessory” use in the village.
Officials have interpreted the ordinance that way, said Village Atty. Daniel Blondin, but the clarification could help deflect a lawsuit.
Filed in April by residents who live near Midwest University, the suit contends two dormitories planned by the university are accessory uses and therefore not legal under village code.
Commissioners are expected to approve the ordinance clarification later this month.
