A federal appeals court has upheld a ruling that Quaker Oats Co., advertising its Gatorade as “thirst aid,” infringed on a trademark owned by a small, 204-year-old Vermont company. The decision by the U.S. 7th Circuit Court of Appeals means the Chicago-based manufacturer could end up having to pay more than $27 million to Sands Taylor & Woods Co. of Norwich, Vt. A spokesman for Quaker said the company has not made a decision about any further appeal.
