Plan Commission members Wednesday night declined to hear an application for development of a 12-lot subdivision after they were surprised to learn that the future ownership of the property was the subject of a court battle.

The matter was referred to the village’s legal department for review.

Commission Chairman Michael Firsel was clearly angry when he announced that he had learned about the lawsuit just moments before the meeting, and he admonished the current owner for not notifying the village’s planning staff.

Firsel said it was not the commission’s job to serve as judge and jury in the civil case.
