After a lengthy debate, trustees early Tuesday approved a settlement for the proposed Terrestris development.

The builders for the 106-acre site at Midlothian and Oakwood Roads had sued last spring after the newly installed Village Board balked at approving the development plan supported by the old Village Board.

Terrestris sued after the board’s new majority-Charles Crawford, Jim Weakly, John Tolomei and Jim Krischke-wanted the developer to reduce the number of town homes to 85 from 143.

The Oak Brook developer wanted the new board to give final approval to the proposal because the old board had supported it.

A compromise plan was offered by Terrestris, but that was stalled for a while Monday night by the debate among the trustees. The compromise called for fewer town homes.

At one point, Trustee Karen Demos-Rosenthal, who was against the compromise, and Krischke, who favored it, faced down each other in a bitter argument. Mayor Deborah Vasels told Demos-Rosenthal she was out of order.

After coming out of an executive session early Tuesday, the trustees approved the development 5-1, with Weakly dissenting.

Crawford said the plan was approved after Terrestris agreed to institute $275,000 in improvements in exchange for 10 more town homes. There will be 95 town homes and 126 single-family homes.
