The Louisiana Supreme Court on Friday set aside a $2.5 billion punitive damage verdict against CSX Corp. for a 1987 tank car fire in New Orleans and returned the case to the lower court. The court ruled that the trial court erred by awarding punitive damages before all liability issues had been resolved.
A leaking car that another railroad left at a CSX interchange caught fire. There were no fatalities, but almost 8,000 people were evacuated.
CSX is one of several firms named in a suit representing about 8,000 plaintiffs claiming injuries. The tank car was filled at a GATX Terminals site and owned by GATX Corp., Chicago.
