The Village of Frankfort has filed a countersuit against the Village of Mokena, alleging that Mokena has violated the 1975 boundary agreement.

Frankfort officials also announced during Monday’s Village Board meeting that Frankfort reached an agreement with Mokena, Frankfort Township and the Frankfort Road Commission regarding the Hickory Creek Marketplace Development.

The agreement, affirmed as a court order by Will County Associate Judge William McMenamin, stipulates that St. Francis Road be used as an entry to Hickory Creek, rather than LaPorte Road.

Frankfort Mayor Raymond Rossi said the agreement averted the possibility of a preliminary injunction hearing.

Mokena, the township and Frankfort Township Highway Commissioner Frederick Rauch filed suit against Frankfort and Hickory Creek’s developers last month against Frankfort and the developers of Hickory Creek Marketplace.

Rauch and the two municipalities object to what they say will be a dangerous traffic situation on LaPorte Road, where Hickory Creek, a 35-acre commercial and retail development, will be located.

Rauch last month said the village and Hickory Creek’s developers had failed to submit plans to him on how they planned to handle increased traffic at that intersection.

A trial date for the LaPorte Road dispute has been set for Jan. 9. Frankfort’s countersuit alleges that Mokena violated the 1975 boundary agreement during the past year when it tried to annex properties within Frankfort’s jurisdiction.

The village also is seeking to have Mokena’s share of the original lawsuit dismissed because Mokena is not contiguous to LaPorte Road east of U.S. Highway 45.
