Bartlett trustees delayed action Tuesday night on a proposed amendment to the building code that would require homeowners to notify their homeowners associations of plans to erect structures that would require building permits.

The Village Board members said they found they had many unanswered questions about the plan and also wanted to consider objections from subdivision resident Art Pierscionek, who told the trustees he feared the proposal would give too much power to the associations.

Village Atty. Bryan Mraz said that under the proposal, homeowners would have to wait for 30 days to allow the association time to determine whether the proposed construction posed any problems.

“The time would allow the association a sufficient time to determine whether the proposed improvement violated any covenants, and educate the owner as to why,” Mraz said. “If the owner is intent on proceeding to construct a prohibited improvement, the 30 days would also allow the association to go to court to enforce the covenant.”
