You report that DuPage County State’s Atty. Joseph Birkett labeled as “inappropriate” DuPage County Board member Michael McMahon’s statement that Rolando Cruz, Stephen Buckley and Alejandro Hernandez–cleared of the Jeanine Nicarico murder–should be taken into the basement and shot (News, Sept. 29).
I wonder what Mr. Birkett would say and do if DuPage County Board members were threatened with the same vigilantism and call for violence that McMahon issued. Is there any doubt that if Cruz, Buckley and/or Hernandez or their lawyers made that statement about County Board members, the police or the prosecutors, they would be arrested? Why isn’t McMahon’s call treated as a hate crime by Mr. Birkett?
Apparently prosecutors still don’t get it. Government cannot do what it pleases in the name of law and order and alleged criminal prosecution. Birkett and McMahon should check their dictionaries under the word “fascism.” In the meantime, why aren’t the feds investigating?
