Michael John Hicks has successfully taken the first step toward having the DNA on a semen-stained pillow case tested to see if it ties him to the rapes he was convicted of committing in 1993.
Calhoun County Circuit Court Judge Allen Garbrecht ruled Monday that he would allow the testing after Hicks’ attorneys successfully argued the DNA test was material to Hicks’s case.
It was the first tryout of a new state law that allows inmates serving sentences for felony convictions to ask the court for DNA testing.
