A federal judge in Chicago has overturned the conviction of a man who has served nearly a third of his 60-year sentence in the sexual assault of a woman during a 1981 concert in the old International Amphitheatre.

The Cook County state’s attorney’s office has 30 days to decide whether to retry 38-year-old Patrick Hampton or release him from prison. Spokeswoman Marcy O’Boyle said the office is reviewing whether to appeal the judge’s decision.

U.S. District Judge Matthew Kennelly ruled Thursday that Hampton’s trial attorney was ineffective and failed to call witnesses who could have rebutted testimony of the victims that Hampton participated in the attack.
