Government lawyer David Frankel said Tuesday in Los Angeles federal court that the former Dodgers star made “flagrantly false and deceptive” claims when he touted the product. .

The Federal Trade Commission contends Garvey should be held personally accountable and is suing him for the $1.1 million he made from endorsing Enforma in 1999 and 2000. The firm has settled a deceptive-advertising lawsuit.

Judge Gary Feess made clear that his decision would hinge not on whether Fat Trapper and Exercise in a Bottle were effective, but whether Garvey made any effort to substantiate his claims.

Harvey Saferstein, one of Garvey’s lawyers, said it is unfair to “tell spokespeople for products that they have to be scientists as well.”
