Rush Limbaugh and the American Civil Liberties Union don’t agree about much, but they’re in accord that the radio commentator’s medical records should be off-limits to prosecutors. The Florida ACLU filed court papers Monday in West Palm Beach supporting Limbaugh’s argument that investigators violated his right to privacy when they seized his medical records in November to investigate whether he violated drug laws.

GOLF COURSE EVICTION: A man who lived on a Florida golf course for 40 years was told to leave because some golfers complained that he scared them. Other golfers, however, said Kenny Bethel is harmless and should be allowed to stay at Miami’s Palmetto Golf Course, where he has lived in a sheltered area since he ran away from home as a teenager in 1963.

POLYGAMY BAN CHALLENGED: A civil rights attorney challenged Utah’s ban on polygamy Monday, arguing that Salt Lake County denying a marriage license to a man who was already married to another woman violated the plaintiffs’ 1st Amendment right to practice their religion.

SOUP DU JOUR: Restaurant chain McCormick & Schmick’s settled a lawsuit Monday brought by a California woman in Santa Ana who said she suffered emotional distress after she found a condom in her clam chowder, a company spokesman said. Terms of the deal were not released.

DOWNLOAD CAMPUS: The launch of Napster’s music service for Penn State students generated about 100,000 downloads Monday, three days after its debut, school officials said. The service is designed to curb music sharing and piracy.

30-MINUTE WORKOUT: Overweight adults who are not on a diet need only a small amount of exercise–the equivalent of a half-hour of brisk walking per day–to prevent further weight gain, a study found. Participants who got no exercise during the eight-month study, however, gained an average of almost 2.5 pounds.
