Contrary to Steven Lubet’s description, there is nothing “tricky” about Antonin Scalia embarking on a hunting trip with Dick Cheney, whose energy meetings he will rule on later this year.

It is unambiguously outrageous.

A justice who refuses to acknowledge the necessity of recusal from a matter in which he is a chum of one of the parties is a justice unfit to serve on the high court–or any court, for that matter.
