Am I the only one who reads about the proposed federal marriage amendment and sees that it is written in such a way that it could be used to support bans on mixed-race marriages?
The proposed amendment states the following:
“Marriage in the United States shall consist only of the union of a man and a woman. Neither this Constitution, nor the Constitution of any state, nor state or federal law, shall be construed to require that marital status or the legal incidents thereof be conferred upon unmarried couples or groups.”
It’s not confined to just same-sex couples, it seems pretty open and could easily be used to protect a state’s mandate to disallow mixed-race marriage or to prevent a citizen from marrying a foreign national.
Regardless of your views on same-sex marriage, the current proposed language for this law is just not well-conceived.
It would leave open a huge can of worms.
