I read and reread your article about the concrete company that attempted to comply with the city and state set-aside programs for minorities. I failed to read anything that would constitute illegal or even unethical business behavior. The company was apparently trying to do the right thing by the minority community while at the same time not jeopardizing its own money or its ability to do business in the future.
Set-asides sound wonderful, but in reality they are just another type of discrimination. That fact becomes magnified when there exists a lack of experienced people to perform the substantive work.
Using litigation to prove your point is not novel; the Tribune does it all the time if a judge tries to prevent portions of litigation from becoming public, or a public figure tries to keep a personal matter private. This company tried to do what was right. It didn’t work. Big deal.
