A Cary contractor whose arrest triggered an ethics investigation of a McHenry County judge admitted Thursday that he “wasn’t thinking” when he ignored a police officer and dumped a load of construction debris to avoid being cited for driving an overweight truck.

David Miller, 51, the longtime owner of Lake Julian Contracting, was stopped June 16, 2007, by a Cary police officer who suspected that his truck was overweight.

Miller was ordered to drive to a weigh station but instead drove to his property and dumped a load of broken concrete.

Miller is on trial in McHenry County Circuit Court on charges of obstruction of justice and destroying evidence.

He had faced a weekend in jail until his brother, Robert, a prominent McHenry County Republican, contacted a judge who held a rare Saturday court session to set bail.

The Illinois Judicial Inquiry Board filed a complaint in February against the judge, Michael Chmiel. The complaint is pending before the Illinois Courts Commission.
