Thank you for accepting this request for public records filed under the Illinois Freedom of Information Act and all applicable open records ordinances and laws.

Please provide me with all police reports since January 1, 2008, pertaining to reported incidents or potential crimes at the following nursing facility:

The requested records may include but not be limited to: arrest reports; call logs; police incident and supplemental reports; correspondence between police and facility administrators; case files; other reports and paper and electronic records.

As you know, under 5 ILCS 140/7(1)(d)(I), basic police incident reports and arrest information are to be provided under FOIA, as well as under the provision of the State Records Act, 5 ILCS 160/4a; the article of the Civil Administrative Code of Illinois concerning the Department of State Police, 20 ILCS 2605/2605-302; the Local Records Act, 50 ILCS 205/3b; and the Campus Security Act, 110 ILCS 12/15.

I respect the privacy rights of nursing home residents, and request that you redact personally identifying information about private parties such as facility residents, witnesses, crime victims and others acting in a private capacity. The nursing homes themselves are not private parties.

I am confident that the release of these basic records will not interfere with any ongoing criminal investigation or hamper pending or actually and reasonably contemplated law enforcement proceedings conducted by any law enforcement or correctional agency. I also believe that release of these basic records will not: deprive any person of a fair trial or an impartial hearing; unavoidably disclose the identity of a confidential source or confidential information furnished only by the confidential source; will not disclose unique or specialized investigative techniques other than those generally used and known or disclose internal documents of correctional agencies related to detection, observation or investigation of incidents of crime or misconduct; and will not endanger the life or physical safety of law enforcement personnel or any other person.
