The attempted murder case filed against a Merrillville woman has been dropped because of a lack of cooperation by the victims.
Prosecutors filed the motion to dismiss Friday, which was granted by Lake Superior Court Judge Diane Ross Boswell, after the victim in the case failed to show for depositions.
Ashley Amber Russell, 21, of the 900 block of West 61st Avenue, Merrillville, was charged with shooting her boyfriend, Rollen Smith, who was bleeding from a wound to the top of his head when police arrived at about 5:17 P.M. May 3 at her family residence.
Witnesses told police that Russell and Smith had been arguing over money.
Smith and two men were standing in the driveway outside the home by a car. One of the witnesses told investigators that Russell went inside the house in a “fit of rage” and returned with a handgun. Russell ran toward Smith, whose back was turned to her. The witness told police he tried to warn Smith that Russell had a gun as Russell fired a shot. The two men who had been with Smith ran after Russell fired the gun, police said.
In addition to attempted murder, charges of battery with a deadly weapon and two counts of criminal recklessness were dropped.
