A state appeals court has ruled that, unlike bar operators, a ”social host” cannot be found liable for serving alcohol to someone involved in a traffic accident and found to be intoxicated. ”The rationale underlying the imposition of liability on a business dispenser of liquor substantially differs from imposition of liability on a nonbusiness dispenser,” the Missouri Court of Appeals in St. Louis ruled. The court upheld a St. Louis Circuit judge`s decision to throw out a wrongful-death claim by William Harriman, whose son was killed when the car he was riding in was involved in an accident.
