The county on Monday got back a portion of its gasoline tax money that has been tied up by a court order as a result of a suit challenging the tax’s legality.
Cook County Circuit Judge Earl Arkiss agreed to free up $680,000, about $1 million less than what McHenry officials hoped would be unfrozen.
Gas tax money collected in Du Page, Kane and McHenry Counties is being held while the suit is pending. The suit charges that the imposition of the tax amounted to special legislation, because it allowed it to be collected in only three counties.
