A McHenry County judge refused Wednesday to lower a $500,000 bond for a Cook County sheriff’s police officer indicted last week for stalking his estranged wife and imposed additional conditions if he is released.

Circuit Judge Ward Arnold ordered Ted Herbert, 47, of unincorporated Richmond to stay at least 1,000 yards from Eileen Herbert, 37, of Richmond, both at home and at work, if he is able to post the required $50,000 as 10 percent of the bond.

Arnold also ordered that Herbert be placed on electronic monitoring and refrain from drinking alcoholic beverages or being in an establishment that serves them.

Arnold denied a motion by Herbert’s attorney, R. Mark Gummerson, to reduce the bond after hearing evidence from prosecutor Philip Possnitz that Herbert has been violent toward his wife since 1991. The alleged violence included threats to shoot her with a high-powered rifle, punching her and stalking her at home and at a nearby laundermat.

Herbert, who has been on disability leave for about two years, has “extensive psychological problems” that include “compulsive, unpredictable and explosive behavior,” Arnold ruled.
