As a former prosecutor and appellate judge, I believe your otherwise fine articles on prosecutorial misconduct (“Trial and error,” Page 1, Jan. 10-14) are unfair to the thousands of former and current prosecutors who strictly followed the rules. Your article mentions only a few who overstepped the bounds to attain a conviction. Yet, the article fails to mention that there have been some who refused to indict or prosecute a case where the evidence didn’t justify a guilty verdict.
Unfortunately the public judges state’s attorneys on their conviction rate rather than their fairness in criminal cases.
