The City Council has given a Wheaton developer a six-month extension of an annexation agreement for the construction of nine single-family houses on 4 acres on Wiesbrook Road.

Developer James J. Pink received council approval in principle in June for the development at 26W301 Wiesbrook Road.

However, the council could not formally annex the property, which is known locally as the Ortenzo property, or approve final zoning for the new subdivision, because Pink had not been able to receive legal title to the land. The council’s annexation agreement was to lapse on Dec. 31 if Pink could not receive title, which would require any application to go through the public hearing process again.

“We just had a deadline to close on it and we didn’t think we’d close by the end of this month,” Pink said. “We’re confident that we’ll close on it in the next six months. We just thought it’d be better to be safe than sorry.”

After Pink takes ownership of the property, which has been tied up in legal action between its two present owners, he will return to the council for what should be routine final approval of the annexation and zoning.
