Batavia Mayor Jeff Schielke broke a 5-5 City Council tie to reject a plan to establish a special taxing district in one of the city`s newer subdivisions that would have financed the maintenance of the neighborhood`s storm water retention pond.
Citing the potential for costly litigation from the residents of the subdivision, Schielke voted with those opposed to the Fox Trail Special Service Area.
Aldermen opposed to creating the district said the service area should have been established before the developer was allowed to sell lots to the new homeowners.
