James McTigue, the Chicago inspector who was fired earlier this year for failing to properly investigate a cave-in in the city`s freight tunnel system that led to the flooding of the Loop in April, appealed his dismissal Wednesday.
In a complaint filed in Cook County Circuit Court, McTigue claimed the dismissal was ”unduly severe.”
In addition, the suit charges that a personnel hearing conducted after his dismissal was biased against him because the hearing officer who conducted the proceedings was appointed by the city`s personnel board.
The personnel board upheld the dismissal earlier this month, claiming that McTigue failed to follow up with an investigation of the cave-in after it was first reported to him in January and that he lied to investigators during an official inquiry of the incident.
