I have read several academics disparage President Bush’s Supreme Court nominee, Harriet Miers, as unqualified based on a lack of impressive law school or professional credentials. While I know little of the nominee other than as reported in the newspapers, both her credentials as a business lawyer and recognition from her partners and colleagues seem very strong (e.g., managing partner of a large Dallas firm, president of her state’s bar association). The Supreme Court needs the business judgment and critical thinking of a lawyer who handles substantial business transactions and cases and who counsels hundreds of hard-to-please business clients.

When I hear academics criticize the intellect and strengths of a business lawyer, I am reminded of the adage that those who can, do, and those who can’t, teach.
