The arrest of a 10-year-old boy for kicking his mother in the leg during a family spat prompted the judge in the case to denounce juvenile justice policies that “completely obliterate common sense.”

Andrew Perkins, a 4th grader who gets A’s and B’s, was charged with battery and held overnight after being handcuffed and hauled away Thursday from a restaurant where the family was dining.

Police reports said a waitress saw Andrew kick his mother, Arlene Martin, who said Tuesday the arrest was foolish.

The judge presiding over the case agreed.

Circuit Judge Thomas Petersen said he expects all charges to be dropped. Another hearing is set for Wednesday.
