New York City’s voters should get to decide whether tax money should be spent on replacing the venerable Yankee Stadium with a new one in Manhattan, a judge ruled Wednesday.

In a blow to Mayor Rudolph Giuliani, State Supreme Court Justice Douglas McKeon released a 15-page decision siding with City Council Speaker Peter Vallone.

The City Council filed a lawsuit in state Supreme Court about six weeks ago against Giuliani, charging him with improperly maneuvering to keep the stadium question off the November ballot.

The controversy over the legendary ballpark has been laced with accusations of political opportunism and gamesmanship, pitting the Republican mayor and Yankees owner George Steinbrenner against Vallone, who is the Democratic nominee for governor this year, and the Democrat-led council.
