Rush Limbaugh asked a Palm Beach County court Monday to hear his claim that investigators violated his privacy by seizing his medical records and asked that the records not be released.
The conservative radio host cannot be treated for his medical conditions because the state seized his charts and files last month and intimidated his doctors, the court petition said. Prosecutors have said they are investigating whether Limbaugh obtained and used prescription painkillers illegally.
2. PETERSON MOTION: Scott Peterson’s lawyer filed a motion Monday to move his double-murder trial out of Stanislaus County, Calif., saying that news coverage of the case has vilified the former fertilizer salesman.
“The lynch mob atmosphere that has been created in this case has become so poisonous that the nature of the news coverage has, in many instances, been reduced to nothing more than vilification,” defense lawyer Mark Geragos said in the motion.
3. POWELL OK AFTER SURGERY: Secretary of State Colin Powell underwent surgery Monday to remove his cancerous prostate gland. “Everything went fine,” his spokesman said. “The surgery took approximately two hours. They say he did extremely well.”
SUPREME MESS: Seven retired Alabama judges, including a former governor, were selected in a lottery Monday to hear Roy Moore’s appeal of his ouster as chief justice, the latest unprecedented twist in his 10 Commandments case.
The drawing came just hours after all eight state Supreme Court justices disqualified themselves from the appeal because of their earlier involvement in the case.
4. POP-UP RULING: A federal judge ruled Monday that a California company can send “pop-up” Internet ads that regulators have called “high-tech extortion”–at least until the matter is decided at trial.
