The presiding Kendall County judge in the battery case against the county’s circuit clerk has asked DeKalb County to hear her case instead, according to a letter filed Thursday in Kendall circuit court.

In the letter, Presiding Kendall Judge Timothy J. McCann wrote to DeKalb County Chief Judge Robbin J. Stuckert.

“Our current circuit clerk, Robyn M. Ingemunson, was charged with a misdemeanor,” McCann wrote.

Pursuant to bond paperwork – copies of which McCann also said he included – the matter had been assigned a court date next month in Kendall County, McCann wrote.

“It is my opinion, as Presiding Judge of Kendall County, that this matter should not be heard by any judge currently sitting in Kendall County,” McCann wrote. “I am asking that you exercise your authority to assign a judge to hear this matter.”

Stuckert declined to comment Friday.

A motion for discovery and a motion for an order to preserve surveillance and security video pertaining to the case both were filed Tuesday.

Ingemunson believes there exist multiple videos from the LakeView Grille in Yorkville. Ingemunson is charged with battery making physical contact, a criminal misdemeanor, in connection to an incident around 8 p.m. Dec. 21 at the restaurant on the 600 block of West Veterans Parkway, according to court records. Ingemunson, 49, of the 2300 block of Iroquois Lane in Yorkville, posted $150 bond, according to court documents filed Monday.

While attending a party at the restaurant, Ingemunson was engaged in a conversation with another woman and became upset, according to police reports. With an open hand, Ingemunson is accused of pushing the side of the other woman’s head once, according to police reports. The other woman did not sustain any injuries, according to police reports.

Attorney Lisa Accardi, who said she is representing Ingemunson “as it relates to any criminal matters,” previously told the Beacon-News that neither she nor Ingemunson had any comment on the battery allegation. Accardi did not respond to a voice mail left Friday afternoon seeking comment on McCann’s request to move future hearings to DeKalb County.

The Kendall County Board in June 2015 voted 6-1 to approve Ingemunson as interim clerk effective that July 1, when she took over for Rebecca Morganegg, who retired as clerk. Ingemunson was then elected to the position in an uncontested race last March. She has worked in the clerk’s office since 2011, according to Beacon-News archives.

Ingemunson is next scheduled to appear in court 8:30 a.m. Feb. 16 in Room 114 at the Kendall County Courthouse in Yorkville. She was at work Friday, according to colleagues, but the Beacon-News was unable to reach her.

All of the case documents filed in Kendall County court are marked with a stamp noting the filing date and the circuit clerk’s name: Robyn Ingemunson.
