A second man from Chicago was charged with fatally shooting a 10-year-old boy and critically injuring a 50-year-old man early July 5 at a family gathering in Gary.

Israel Olivas, 33, is charged with murder and three counts of attempted murder, all Level 1 felonies; aggravated battery, a Level 3 felony; unlawful possession of a handgun, a Level 4 felony; and unlawful carrying of a handgun, a Level 5 felony, along with a misdemeanor gun charge and a firearms enhancement on multiple charges, court records state.

Olivas is accused of driving Hector Posadas to the Gary house that he had left hours earlier after a confrontation with a woman, according to court records. Ring doorbell footage showed Posadas arrived around 12:45 a.m. on July 5 and shot at the porch area of the house in the 200 block of Chase Street.

Posadas was charged last week in the shooting, court records show.

A 10-year-old boy and a 50-year-old man were taken to Methodist Hospital-Northlake with gunshot wounds.

Montana Weathers, 10, was pronounced dead at 1:43 a.m. on July 5 at Methodist’s emergency room, according to a Lake County coroner’s press release. An autopsy determined the cause of death to be a gunshot wound to the head. The 50-year-old man was shot in the stomach, records show. He was later transported to the University of Chicago Medical Center in critical condition. A family member told police that he was too weak for surgery due to blood clot issues.

Police reviewed Ring doorbell footage, which showed Posadas arriving around 5 p.m., wearing a distinctive T-shirt with a Chicago Bears theme and dark jeans. Around 12:46 a.m., a black minivan is visible in front of the residence and two men approach the sidewalk in front of the house, records state. A man wearing the same Bears shirt and resembling Posadas emerges from the driver’s seat, the affidavit states, while a man in a gray sweater, who looks like Olivas, is visible. Posadas stops in front of the house and states, “Who punched me?” while gesturing with his handgun before opening fire at the front porch, the affidavit states. Olivas is also seen pointing a handgun at the house. Muzzle fire is seen coming from the handgun Posadas is holding, records state.

After the shots, Posadas and Olivas fled back to the van. A man leaves the house and returns gunfire as the van takes off, court records state.

Police recovered at least eight spent 9 mm casings in front of the house and two spent projectiles were found inside the house, records state. Marks appearing to be blood were found just inside the front door of the residence.

Investigators determined that the Chrysler Pacifica allegedly used during the shooting was registered to Olivas, records state. A search warrant conducted in the vehicle uncovered the Bears T-shirt that Posadas was wearing, which now had bleach stains on it, as well as three bullet projectiles, two inside the back passenger door, and one on the front passenger side floorboard.

According to court records, Israel Olivas was previously convicted of aggravated robbery and robbery in Cook County Circuit Court, which makes him a serious violent felon under Indiana Law.
