A Thayer man who admitted he was on heroin when his two young boys drowned in the Kankakee River in 2018 is seeking a lower bail, records show.

A hearing is set for March 17 in front of Lake Superior Judge Samuel Cappas.

Eric Patillo, 36, is charged with two counts of neglect of a dependent resulting in death, both Level 1 felonies, Lake County court records show. He has been in jail since his bail was set at $100,000 three days later.

Levi Patillo, 4, and Evan Patillo, 2, were unresponsive when they were pulled the afternoon of Aug. 21, 2018, from the Kankakee River in DeMotte, according to the Indiana Department of Natural Resources. The preliminary causes of death for the boys was asphyxia due to drowning, according to court records.

Family members said then that Patillo had been struggling with addiction for several years.
